Please read these terms carefully before using Telerge’s telecommunication services.

About Telerge

Telerge is a cloud communications company offering unified communications, contact center solutions, and communications APIs to businesses of all sizes. We are headquartered at 5322 Barcola Avenue, Las Vegas, NV 89139.

Throughout these Terms, "Telerge,""we,""our," or "us" refers to Telerge and its affiliated entities. "You" or "your" refers to any individual or business that accesses or uses our services.

Who Can Use Our Services

To use Telerge's services, you must meet the following requirements:

  • You are at least 18 years old.
  • You have the legal authority to enter into a binding agreement on behalf of yourself or your organization.
  • You are not located in a country subject to a US government embargo or on any US government restricted-party list.
  • Your use of our services complies with all applicable local, state, and federal laws.

By creating an account or using our services, you confirm that you meet all of the above requirements.

Your Account

To access most of our services, you'll need to create an account. Here's what that means for you:

  1. Account Accuracy

    You agree to provide accurate, current, and complete information when setting up your account and to keep that information up to date. Providing false or misleading information may result in suspension or termination of your account.

  2. Account Security

    You are responsible for keeping your login credentials secure. Do not share your password with anyone. If you suspect unauthorized access to your account, notify us immediately at info@telerge.com. Telerge is not liable for any loss resulting from unauthorized use of your account.

  3. Account Termination

    You may close your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use our services in a way that harms others.

Our Services

Telerge provides cloud-based communications tools including:

  • Unified Communications: voice, video, messaging, and collaboration tools for your team.
  • Contact Center Solutions: cloud-based customer support infrastructure for businesses.
  • Communications APIs: programmable tools that let developers build custom communication workflows using voice, SMS, video, and verification.

We reserve the right to modify, update, or discontinue any part of our services at any time. When possible, we will give you advance notice of significant changes.

  1. Service Availability

    We work hard to keep our platform running reliably, but we do not guarantee 100% uptime. Scheduled maintenance, technical issues, or circumstances beyond our control may occasionally cause interruptions. We will notify you of planned downtime in advance whenever possible.

  2. Third-Party Integrations

    Some of our services may connect with third-party platforms or tools. Telerge is not responsible for the performance, availability, or privacy practices of any third-party service. Your use of those integrations is subject to their own terms and policies.

Acceptable Use

Our services are designed for lawful business communication. By using Telerge, you agree not to:

  • Use our platform for any illegal purpose or in violation of any applicable law or regulation.
  • Send spam, unsolicited messages, or bulk communications without proper consent from recipients.
  • Harass, threaten, or harm any individual or group through our services.
  • Attempt to gain unauthorized access to our systems, other accounts, or any connected networks.
  • Use our services to distribute malware, viruses, or any harmful code.
  • Misrepresent your identity or impersonate another person or organization.
  • Resell or sublicense access to our services without our written permission.
  • Reverse-engineer, copy, or create derivative works of our platform or software.

Violating these rules may result in immediate suspension or termination of your account without notice, and may be reported to the appropriate authorities.

Billing and Payments

Fees

Telerge offers various pricing plans. The fees for your selected plan will be clearly outlined at the time of purchase. By subscribing to a paid plan, you authorize Telerge to charge your payment method on the billing cycle you selected.

Payment Method

You are responsible for keeping your payment information current and accurate. If a payment fails, we may suspend access to your account until the balance is resolved.

Refunds

Payments are generally non-refundable. If you believe a charge was made in error, contact us at billing@telerge.com within 30 days of the charge. We will review and resolve billing disputes on a case-by-case basis.

Price Changes

We may update our pricing from time to time. We will give you at least 30 days' notice before any price increase takes effect. Continued use of our services after a price change means you accept the new pricing.

Intellectual Property

All content, software, branding, logos, and technology on the Telerge platform are owned by Telerge or its licensors and are protected by US and international intellectual property laws.

By using our services, we grant you a limited, non-exclusive, non-transferable license to access and use our platform for your own business purposes. You may not copy, modify, distribute, or create derivative works from any part of our platform without our written consent.

Any content you create, upload, or transmit through our services remains yours. By using our platform, you grant Telerge a limited license to process and store that content solely to deliver the services to you.

Privacy

Your privacy is important to us. How we collect, use, and protect your personal information is explained in our Privacy Policy, available at telerge.com/privacy.

By using our services, you agree to the collection and use of your information as described in that policy. If you have questions about how we handle your data, contact us at privacy@telerge.com.

Disclaimers

Telerge provides its services "as is" and "as available." While we work hard to deliver a reliable platform, we make no guarantees that:

  • Our services will always be available, uninterrupted, or error-free.
  • Our services will meet every specific business requirement you may have.
  • Any errors or defects will be corrected immediately.

To the fullest extent permitted by law, Telerge disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, Telerge and its officers, directors, employees, and partners will not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of our services.
  • Loss of revenue, data, business, or profits — even if we were advised of the possibility.
  • Damages resulting from unauthorized access to your account or communications.

In any case, our total liability to you for any claim arising from your use of our services will not exceed the amount you paid to Telerge in the 3 months before the event that gave rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Telerge and its team from any claims, damages, losses, or expenses (including reasonable legal fees) that arise from:

  • Your use or misuse of our services.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property or privacy rights.
  • Any content you transmit through our platform.

Changes to These Terms

We may update Telerge’s terms and conditions from time to time to reflect changes in our services or legal requirements. When we make significant changes, we will notify you by posting a notice on our website or sending an email to your account.

Your continued use of our services after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you should stop using our services and close your account.

Governing Law

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our services will be resolved in the courts located in Clark County, Nevada.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
